Illegal Obstruction of Ancient Public Right of Way

An ancient public right of way (PROW) in Hanham, which is a favourite route for many residents, is currently obstructed by landowners, causing significant inconvenience to the community.


The affected PROW (PHA/6/20) stretches approximately 200 metres, connecting Common Road in Hanham to Hencliff Wood, an integral part of the Avon Valley Woodlands nature reserve. Unfortunately, the land along this path has been ploughed and planted with maize (sweetcorn), which has now grown several feet high, completely blocking access for walkers.


The obstruction of a public right of way is a criminal offence, and as such, the Highway Authority has the right to demand immediate removal of any such obstruction caused by the landowners. According to government guidelines, cultivating a cross-field footpath is to be avoided entirely. If cultivation is unavoidable, landowners are required to ensure that the footpath remains apparent on the ground, with a minimum width of one metre and is not obstructed by crops.


Furthermore, the government website clearly outlines the necessary measures to be taken in case of cultivation. The footpath must be restored to its minimum width within 14 days of first being cultivated for that crop and within 24 hours of any subsequent cultivation unless a longer period has been agreed upon in advance in writing by the Highway Authority.


South Gloucestershire Public Rights of Way team were informed of the obstruction on 24th June 2023, but so far no enforcement action appears to have been taken. We urge South Gloucestershire Council to address this matter promptly and ensure the removal of the obstruction to reinstate the right of way for the local community. It is vital that our public pathways are respected and maintained to preserve the well-being and enjoyment of all residents who cherish the opportunity to explore the beautiful surroundings.
